Terms of Service

These Terms of Service ("Terms") form a binding agreement between you ("you", "user") and Kosmonia ("we", "us", "our"), operated by MoZayed, based in Cairo, Egypt and reachable at info@mo-zayed.com. By creating an account or using kosmonia.mo-zayed.com, the kosmonia-ai.lovable.app domain, or any related service (collectively, the "Service"), you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Kosmonia is a productivity, focus, and gamified learning web application. It includes focus timers, ambient sound mixing, task and quest management, RPG-style progression, campaign planning, AI-assisted guidance, and (for paid tiers) live focus rooms, analytics, exports, and team features. We may add, modify, deprecate, or remove features at any time. Material changes that materially reduce paid features will be communicated by email or in-app at least 14 days in advance where feasible.

2. Eligibility & accounts

• You must be at least 16 years old, or the minimum digital-consent age in your jurisdiction, whichever is higher.
• You must provide accurate registration information and keep it up to date.
• You are responsible for all activity under your account and for safeguarding your password and any third-party login (e.g. Google) you connect.
• One person, one account. Sharing accounts is not permitted.
• Notify us promptly at info@mo-zayed.com of any suspected unauthorized use.

3. Subscription tiers, trials & billing

Kosmonia offers a free Free tier and paid Focus and Studio tiers, billed monthly or annually. Specialized tiers (Creator, Education, Developer, Enterprise) may be offered separately.

• Merchant of Record: All payments are processed by Polar.sh, acting as Merchant of Record. Polar collects and remits applicable sales tax / VAT and is the contracting party for the payment transaction.
• Auto-renewal: Paid subscriptions renew automatically at the end of each billing period at the then-current price for your tier, unless you cancel beforehand via Settings → Manage subscription.
• 14-day Studio trial: If you start the in-app Studio trial, you receive 14 days of Studio-tier access. The trial is one-time per account and does notrequire a payment method. At the end of the 14 days you are automatically returned to the Free tier unless you separately purchase a paid subscription.
• Price changes: We may change subscription prices. Changes apply only to renewals after at least 30 days' notice.
• Refunds: See our Refund Policy.
• Failed payments: If a renewal fails, your account may be downgraded to Free until payment is restored.

4. Acceptable use

You agree not to:

• Use the Service to violate any law, regulation, or third-party right.
• Reverse engineer, decompile, scrape, or attempt to extract source code, except as permitted by law.
• Attempt to gain unauthorized access to any part of the Service, other accounts, or our infrastructure (e.g. probing, brute force, exploiting vulnerabilities).
• Upload malware, spam, or content that infringes intellectual property, is unlawful, hateful, harassing, sexually explicit involving minors, or otherwise abusive.
• Resell, sublicense, or use the Service to build a competing product.
• Abuse the AI features (e.g. prompt-injection, automated bulk querying, attempts to exfiltrate model data, or generate disallowed content).
• Use the live focus rooms to share illegal content or harass other participants.

We may suspend or terminate accounts that violate these rules, with or without notice.

5. Your content

You retain ownership of all content you create or upload, including tasks, quests, journals, campaigns, sound profiles, branding assets, and reflection entries ("User Content"). You grant us a worldwide, non-exclusive, royalty-free license to host, store, transmit, and display your User Content solely as necessary to operate, secure, and provide the Service to you, and to comply with law. We do not sell your User Content and do not use it to train AI models.

You represent that you own or have the right to use any content you upload (including custom branding logos and images).

6. AI features

• AI-generated outputs (e.g. campaign suggestions, daily briefings) are provided for informational purposes only and may be inaccurate, incomplete, or outdated. You are responsible for evaluating outputs before relying on them.
• AI prompts you submit are sent to our AI provider (Lovable AI Gateway by default, or your own configured provider) for processing.
• If you supply your own AI API key, it is encrypted server-side and used only to serve your own requests. You remain responsible for the costs and terms of your third-party provider account.
• Do not submit personal data of others, confidential third-party information, or regulated data (medical, financial, legal) into AI prompts.

7. Intellectual property

The Service, including its software, design, logos, brand, and ambient sound library (where licensed by us), is owned by us or our licensors and protected by intellectual property laws. We grant you a limited, revocable, non-transferable, non-exclusive license to use the Service for your personal or internal business use, subject to these Terms.

8. Third-party services

The Service relies on third-party providers, including Supabase (database and authentication), Polar.sh (payments), Resend (transactional email), Lovable AI Gateway, and optionally OpenAI / Anthropic / Google AI when you configure them. Their terms and policies apply to your use of those underlying services.

9. Termination

• You may stop using the Service at any time. To delete your account and associated data, email info@mo-zayed.com from your account email; deletion is processed within 30 days.
• We may suspend or terminate your access immediately if you materially breach these Terms, if required by law, or if continued provision creates a security or legal risk.
• On termination, your license to the Service ends. Sections that by their nature should survive (ownership, disclaimers, liability, indemnity, governing law) will survive.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy, or that the Service will be uninterrupted, secure, or error-free. Productivity, focus, and gamification features are tools, not medical, psychological, educational, or professional advice.

11. Limitation of liability

To the maximum extent permitted by applicable law, in no event will we be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, or goodwill, arising out of or relating to the Service. Our total aggregate liability for any claim arising out of or relating to the Service is limited to the greater of (a) the amounts you paid us in the 12 months preceding the event giving rise to the claim, or (b) USD 50.

Some jurisdictions do not allow certain limitations; in those jurisdictions our liability is limited to the smallest extent permitted by law.

12. Indemnification

You agree to defend, indemnify, and hold us harmless from any claim, damage, or expense (including reasonable legal fees) arising out of (a) your use of the Service, (b) your User Content, (c) your violation of these Terms, or (d) your violation of any law or third-party right.

13. Governing law & disputes

These Terms are governed by the laws of the Arab Republic of Egypt, without regard to conflict-of-laws rules. The competent courts of Cairo, Egypt have exclusive jurisdiction over any dispute, except that consumers domiciled in the European Economic Area or the United Kingdom may also bring proceedings in their country of residence and benefit from any mandatory consumer-protection rules of that country.

14. Changes to these Terms

We may update these Terms. The "Last updated" date at the top reflects the most recent version. Material changes will be notified by email or prominent in-app notice at least 14 days before they take effect, unless an earlier change is required by law. Continued use after the effective date constitutes acceptance.
